The Joffrey Workshop SMS Messaging Terms & Conditions

Effective Date: January 1, 2026

These SMS Messaging Terms & Conditions (“SMS Terms”) govern participation in The Joffrey Workshop text messaging program (“Program”). By providing your mobile number and opting in, you agree to these SMS Terms.

1. Consent to Receive Messages (TCPA Compliance)

By opting in, you provide prior express written consent under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, to receive recurring automated marketing and informational text messages from The Joffrey Workshop at the mobile number provided.

Messages may be sent using an automatic telephone dialing system.

Consent is not required for purchase, enrollment, or participation.

Message frequency may vary; marketing and non-marketing (transactional) messages may be sent.

We maintain records of consent in accordance with federal and state law.

2. Texas Telemarketing Acknowledgment

In accordance with Texas Business & Commerce Code Chapter 305:

You provide express consent to receive business-related text communications.

You may revoke consent at any time.

Opting out does not affect program participation but may limit timely communication.

We do not send SMS communications without documented consent where required by law.

3. Opt-Out & Help

To unsubscribe, reply STOP. You will receive a single confirmation message and will no longer receive messages unless you re-enroll.

Opt-out requests are processed promptly as required by law.

4. Message Frequency & Charges

Up to approximately four (4) messages per month.

Standard message and data rates may apply; charges are set by your wireless carrier.

The Joffrey Workshop is not responsible for carrier-imposed fees.

5. Eligibility & Mobile Number Ownership

By enrolling, you confirm that you are the subscriber or authorized user of the mobile number provided. You agree to notify us of any number changes. We are not responsible for messages sent to reassigned, recycled, or incorrect numbers.

6. Carrier & Delivery Disclaimer

We do not guarantee delivery, timeliness, or accuracy of messages. Carriers are not liable for delayed, undelivered, misdirected, or incomplete messages.

7. Limitation of Liability

To the fullest extent permitted by law, The Joffrey Workshop is not liable for:

Delays or failed delivery

Content errors

Technical malfunctions

Unauthorized access

Carrier issues

Any indirect, incidental, consequential, statutory, punitive, or special damages

Your sole remedy is to opt out.

8. Arbitration & Dispute Resolution

Disputes arising from the Program or these SMS Terms (including TCPA claims) will be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA).

No class actions or class arbitration permitted.

Arbitrator may award remedies allowed by law.

Judgment may be entered in any court with jurisdiction.

Arbitration costs follow AAA rules unless law requires otherwise.

By agreeing to arbitration, you waive your right to a jury trial and to participate in any class or representative proceeding.

9. Privacy

Information collected is governed by our Privacy Policy. We do not sell or share mobile numbers except as permitted by law.

10. Modifications

We may modify or terminate the Program or these SMS Terms at any time. Changes are effective upon posting to our website. Continued participation constitutes acceptance of updated Terms.
